These terms cover your use of ProjectA3 — this website and the game server it runs. By creating an account, signing in, or playing, you accept them. If you do not accept them, do not use the service.

Who you are agreeing with

ProjectA3 is a private server run by a small group of players in their own time, as an unpaid hobby. It is not a company, it is not a shop, and nobody is employed by it. Where these terms say we, us or the staff, that is who is meant.

Who may play

You must be 18 or over to hold an account here. A3 is an adult game — it was rated for adults where it was published, and this server does nothing to soften that — so there is no younger tier, no parental consent route, and no supervised account. By registering you confirm you are 18 or over.

We may close, without notice and without appeal, any account we have reason to believe is held by someone under 18, and we will delete what is stored with it. If you know of one, tell us.

You are responsible for whether using this service is lawful where you are. If it is not, do not use it.

Your account

You need an account to play. Keep its password to yourself: everything done with your account is treated as done by you, including anything done by someone you gave access to. One person may hold more than one account, but every account is bound by these terms and by the code of conduct, which forms part of them.

An account is personal to you. It may not be sold, rented, gifted or transferred, and any attempt to do so may cost you the account.

We may suspend or close any account at any time — for breaking these terms, or for any other reason we judge good, or for no reason at all. Where an account is closed for breaking the rules, nothing is refunded and nothing is restored.

The game and everything in it

Characters, items, currency, ranks and progress exist only as entries in this server's database and remain part of it. You are licensed to use them while your account is open; you do not own them, they are not property, they cannot be sold for real money, and they carry no cash value inside the game or outside it. Trading them outside the game is prohibited.

We may change, reset, remove or rebalance any of it at any time. Rates, drop tables, item statistics, currency balances and entire characters may be altered or wiped, whether as part of a planned change, to correct a bug or an exploit, or because the server is restored from a backup. You will not be compensated for anything lost that way.

The game client

The client is supplied for use with this server only. You install and run it on your own machine at your own risk. It is not signed, antivirus software may object to it, and we give no assurance about how it behaves on any particular system. We are not responsible for damage to your device, your operating system or your files.

Do not decompile, modify, repackage or redistribute the client, and do not obtain it from anywhere other than the channels we point you at.

Other people's rights

A3, its artwork, its music, its names and its assets belong to their respective rights holders. ProjectA3 is an unofficial fan-run server. It is not affiliated with, licensed by, sponsored by or endorsed by the game's publisher, developer or any other rights holder, and nothing here should be read as a claim to their property.

If you hold rights in anything shown or used on this server and you want it taken down, tell us and we will act on it promptly. Send enough detail to identify the material and your claim to it, to [email protected].

Everything on this website that is our own — its text, its layout and its code — stays ours. You may read and print pages for your own use. Please do not republish, sell or sub-licence them, or copy the site wholesale elsewhere. Linking to us is welcome.

What you write

Character names, guild names, chat messages, support tickets and anything else you submit are yours to answer for. By submitting them you give us permission to store and display them as part of running the service. We do not monitor everything that is said, we are not responsible for what other players say to you, and we may remove or rename anything without notice.

Payment

Rules, and how they are enforced

The code of conduct is part of these terms. Enforcing it is at our discretion: we decide what to look into, what a rule means, and what to do about a breach, and we are under no obligation to investigate any report, to act on one, or to explain a decision. Not enforcing a rule on one occasion does not waive it.

We may act against every account we believe is linked to the same person. Nothing lost to enforcement is restored or compensated.

The service is offered as it is

This is a hobby server run on whatever hardware and connection is available at the time. It is provided as is and as available, and to the fullest extent the law allows we give no warranties, conditions or guarantees of any kind, whether stated or implied — including any implied assurance that the service is of satisfactory quality, fit for any purpose, uninterrupted, timely, secure, free of errors, or that anything stored in it will survive.

Downtime, maintenance, rollbacks, wipes, rate changes, lost characters, lost items and permanent closure are all possible, at any time and without notice. Where we can give notice we will, on the news page.

What we are answerable for

To the fullest extent the law allows, we are not liable to you for any loss or damage arising out of the service or your use of it. That includes — but is not limited to — lost accounts, lost characters, lost items, lost currency, lost progress, lost time, lost opportunity, damage to your device or data, the acts of other players, and any indirect or consequential loss of any kind, whether or not we were warned it was possible.

Where liability cannot lawfully be excluded, our total liability to you for everything arising out of the service is limited to the total amount you have actually paid us in the twelve months before the claim. On a free server that figure is nothing, and this section is the reason it matters that it is.

Nothing here tries to exclude liability that cannot lawfully be excluded, and nothing here removes any right you have under the consumer law where you live that cannot be signed away.

If a claim comes from something you did

If someone brings a claim against us because of what you did — how you used the service, what you posted, a rule you broke, or a right of theirs you infringed — you agree to cover the cost of dealing with it, including reasonable legal costs, and to leave us out of it as far as you are able.

Things outside anyone's control

We are not answerable for a failure or delay caused by something we do not control: hosting or network failure, power loss, attack, a change in the law, or anything else of that kind.

The website

The site uses cookies to keep you signed in and to protect its forms. Using the site means accepting that, as described in the privacy policy.

Links to other places — Discord above all — are for convenience. What happens there is governed by their rules, not ours, and we are not responsible for them.

Do not attempt to break into, overload, scan, scrape or interfere with this site, the game server, or anyone's account on either.

Ending it

You may stop using the service and ask for your account to be deleted at any time. We may close the service, or your access to it, at any time. The sections about what the game contains, other people's rights, what we are answerable for, and claims arising from what you did all survive your account being closed.

The rest of the small print

If any part of these terms turns out to be unenforceable, the rest still stands and that part is read as narrowly as it needs to be to work. These terms, together with the code of conduct and the privacy policy, are the whole of the agreement between us, and replace anything said elsewhere — on Discord, in game, or by any member of staff. You may not transfer your rights under them; we may transfer ours if the server changes hands.

Changes

These terms may change. Material changes will be announced on the news page, and continuing to use the service after that means accepting the new version. If you do not accept it, stop playing and ask us to delete your account.
